The text and visuals of the website are not contractual and do not engage the company Les Vins de Pierre Boinet in any way. The products offered conform to the current French legislation and to the norms applicable in France.
The availability of articles is indicated on the website. However, if an error occurs due to us, you can cancel or modify your order. Our wines are delivered within the limit of available stock, apart from promotions or special offers.
Prices
The prices on our site are written in Euros, including tax for individuals and excluding tax for professionals (except wines en primeur, which are shown without VAT and without transport costs, except where it is indicated differently). They are given as a guideline and can be modified at any time.
The transport costs are studied and communicated to the client according to the order, by return.
For the wines en primeur, one should refer to the conditions shown on the offer, in the limit of available stock.
Orders
To order, all clients must be over 18 and have adequate physical, moral and financial capacities.
Orders are confirmed when an invoice is sent out. All orders are definitive and deliverable after reception of the whole payment for the price of the merchandise.
The company Les Vins de Pierre Boinet reserves the right to cancel any client’s order if there was to be any dispute with said client.
For the time being, we only accept orders which can be delivered within metropolitan France
Modes and conditions of payment
Payment for merchandise, including cost of shipping if relevant, must be paid fully at the time of ordering, either by cheque addressed to Vins de Pierre Boinet, or by debit card (Carte Bleue), Visa, Eurocard Mastercard, or else by payment on our account (contact us).
No statement of payment can be made without our express prior consent.
Deliverable wines
An invoice in Euros (including tax) will be sent by Les Vins de Pierre Boinet to the client at the billing address indicated.
En Primeur Wines
Orders of wines en primeurs lead to a deposit of the whole price excluding tax and delivery costs being paid. As soon as you receive your order and that we receive payment, we will send you a pro forma invoice excluding tax.
After we have sent you the wine, we will send you a definitive invoice including VAT and the cost of shipping.
Deliveries
We would like to remind you that the cost of delivery is studied and communicated to you by return, dependant on the order, prior to being invoiced.
Our deliveries take on average 7 working days from the date of payment of the order. This time of delivery is indicated as precicely as possible, but can change according to stock, transport, climate conditions or any other event outside of our control which could stop your delivery (strike, breakdown, etc.).
Deliveries which take longer than anticipated cannot lead to damages and interest, to ongoing orders being withheld or cancelled.
In any case, the delivery can only take place if the client has communicated correctly to the seller the delivery address. If an error was to occur, we could not be held responsible for being unable to deliver the merchandise to the right place or in time.
When the client receives the merchandise, it is his/her responsibility to check it and to note any findings necessary. If there was to be breakages, damage or anything missing, the client must write down his reservations on the delivery slip, and address them and any comments to the transport company (in the 48 hours following delivery), by registered post with a receipt, with a copy sent to the Les Vins de Pierre Boinet company, in order to preserve their rights.
Delay in Payment
All delays in payment will delay the delivery of the merchandise.
Clause of retention of property
By express agreement, all our merchandise remains our property wherever it is, up to when the full payment of due invoices is paid. This does not exclude the transfer of risks on goods to the buyer once the goods have been delivered.
Alcohol abuse
Alcohol abuse is dangerous for your health. Please consume and appreciate alcohol with moderation.
Applicable and competent law and jurisdiction
The present general conditions of sale are subject to the application of French law, excluding the dispositions of the Vienna Convention.
Regarding sales between private individuals, the directives and rules of the European Union, in particular the Brussels convention, will be applicable.
The present contract is subject to French law. The language of the present contract is French. In case of litigation the French courts will be competent.
Protection of minors
In accordance with the article L. 3342-of the Code of Public Health with stipulates that the sale of alcohol to minors under the age of 16 is prohibited, the buyer engages themselves, by filling in the order form, to be sixteen on the date of the order.
Data protection
In accordance with the law n° 98-536 of 1st July 1998, transposing the directive 96/9/CE of 11 March 1996, concerning the legal protection of databases, the company Les Vins de Pierre Boinet produces and owns all or part of the databases from which the present site is composed. All information which figures on this site (text, images, graphics, logos, icons) are protected by the author’s rights.
Use of Privacy Policy
This site was subject to a declaration to the CNIL N° XXXXXX. The collected information on the interfaces of the site can be subject to external communication apart from when the client has refused this. The communication of this information can also be carried out for legal reasons.
